SCOTUS Decision on Affirmative Action: Impact on Recruiting?
On June 29, 2023, the U.S. Supreme Court declared that the race-based admission practices implemented by Harvard and UNC Chapel Hill violate the Equal Protection Clause of the 14th Amendment. Consequently, colleges will need to revise their admissions policies, including those for recruited athletes, to ensure that they do not engage in racial discrimination during the evaluation of applicants. The Supreme Court opinion refrained from discussing the potential intersection of applicant race and changes to college athletics, which raises several complex questions that universities, the NCAA, and NAIA will need to grapple with in the near future.
